The Daryabi Exchange® online money transfer service (“Service”) is provided in Australia by Daryabee Enterprises Pty Ltd. (“we” or “us”). By using our remittance services, the user (“you” or “your”) agree to these Terms and Conditions, as well as any policies or guidelines provided at the time of each transaction. If you do not agree, please do not use our services. - Services Provided
We offer both online and in-person remittance services, allowing you to send money to recipients in selected regions. - Your Responsibilities
Verification and Compliance: You must provide accurate details for each transaction, including recipient information, and ensure compliance with all Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) laws. We may request further documentation as required by law (See AML/CTF Policy).
Transaction Limits: Transaction limits vary by region due to local regulatory requirements, and you are responsible for following these limits as stated in the transaction summary.
Truthful Declarations: You must declare truthful and accurate purposes for all transactions and avoid engaging in any illegal activities. - Fees and Charges
The chosen currency, applicable fees, agreed exchange rate, and final converted amount will be shown on the transaction form and summary. We reserve the right to apply variable fees depending on transaction regions and will notify you of any adjustments prior to confirmation. - Processing Times and Delays
Standard Processing Times: We strive to process transactions promptly; however, online transactions may require up to 5 business days, while in-person transactions are generally processed immediately unless further checks are needed.
Disclaimers for Delays: Delays may occur due to third-party service providers, public holidays, bank processing schedules, regulatory reviews, or network outages. We are not liable for delays due to these factors. - Cancellations and Refunds
Cancellation Policy: You may cancel a transaction; however, a cancellation fee will apply. All fees are non-refundable unless the transaction was processed in error.
Refunds for Errors: If a transaction error occurs, please report it within 3 to 5 business days for review. We will assess eligibility for refunds on a case-by-case basis (See Refund Policy). - Data Protection and Privacy
Personal Information Use: We collect personal and financial information to complete transactions and comply with regulatory requirements, following the Privacy Act 1988 (Cth).
Data Security: We use secure systems to protect your data from unauthorized access. By using our services, you consent to necessary data sharing with regulatory and financial bodies, as required by law. - Liability and Disclaimers
Limitation of Liability: We are not liable for losses due to system outages, third-party service disruptions, or currency fluctuations. Where permitted by law, our liability is limited to the fees paid for the transaction.
External Factors: We are not responsible for delays or issues arising from non-compliance with local laws, regional transaction limits, or third-party services. - Dispute Resolution
Complaints and Conflict Resolution: Please contact our support team to resolve any transaction-related disputes. We encourage resolution through negotiation or mediation before any formal legal action.
Arbitration Clause: If a dispute cannot be resolved amicably, you agree to submit the matter to binding arbitration under Australian jurisdiction. - Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia, and you agree that any legal proceedings will be filed in the courts within this jurisdiction.
